Co-Working Memberships

Active membership in a co-working space located at an eligible address can serve as proof of a business presence within the legally defined geographic area. Applicants must show an ongoing, active connection to a physical workspace that supports their business operations.

  • Eligible memberships include arrangements that provide consistent, in-person access to shared or dedicated work areas.

  • Memberships must have been established prior to August 1, 2025, in order to meet this requirement. 

The review process will factor in the type of membership, the duration of engagement, and a reasonable link between the nature of business activities and the work performed at the co-working space. This ensures that the co-working space arrangement aligns with the intent of the law.

Types of Co-Working Space Memberships That DO Qualify 

  • Ongoing private office rental: Dedicated office space with continuous access for the applicant. 

  • Reserved desk membership: A specific desk assigned to the applicant for regular, exclusive use. 

  • Shared desk or open workspace membership with documented physical presence: The applicant must hold a membership that includes access to an in-person workspace and provide proof of consistent on-site use (e.g., check-in records or attendance logs).

Types of Co-Working Space Memberships That DO NOT Qualify 

  • Mailing-only or virtual mail services: Memberships that provide only a mailing address or mail handling without access to physical workspace. 

  • Virtual-only memberships: Plans offering online access to services or networking without access to physical workspace. 

  • Occasional day-pass or drop-in access: Memberships that do not guarantee regular, dedicated space for the applicant. 

  • Memberships lacking sufficient timeline or operational connection: Memberships established after August 1, 2025, or memberships that do not reasonably align with the type of work performed at the co-working space. For example, businesses without a clear need for office-based work may not qualify.
